Copyright & Photo and Video Usage
At ConeCat, we believe transparency is part of our professional standard. This section explains, in plain terms, how the rights to the photos and videos we produce work.
Authorship & ownership
Every photograph, video, and audiovisual content produced by ConeCat is ConeCat's intellectual property, protected by copyright from the moment it's created. Hiring our services does not transfer ownership of the photos or videos; it grants a license to use them for the agreed purpose.
What your license includes
When you book a session, you receive a license to use the material (photos, videos, drone tours and reels) for the specific commercial activity it was requested for, for example, promoting and selling a property on real estate portals, social media, and related marketing materials. This license is valid while that activity is active (for example, while the property is for sale).
Additional use or a different commercial activity
If the same material is going to be used for another commercial activity beyond the one originally agreed, for example, photos or videos made to sell a property that are later used to market that same property as a vacation rental (Airbnb, Booking, etc.); this constitutes a second commercial benefit derived from the same photo or video work, and an additional charge of 50% of the original activity's fee applies.
This also applies when:
- The property changes owners and the new owner wants to use the same photos or videos.
- A third party (designer, developer, another agent) wants to use the material for their own marketing purposes.
- The material is used in a different channel or campaign than the one originally contracted.
What's not allowed without authorization
- Resale or transfer of the photos or videos to third parties unrelated to the contracted activity.
- Use of the material beyond the agreed timeframe or purpose without arranging an extended license.
- Modification, cropping or re-editing of the material (including cutting, re-editing or changing the music of a video) that alters its integrity without prior consultation.
Want to expand the use of your photos or videos?
We're happy to talk about extended or multi-use licenses. Write to us at info@conecat.cr and we'll coordinate the additional activity before it's published.
